• Surrogacy in Kyrgystan

    Legal Status

    Surrogacy is legal in Kyrgyzstan under the Law on Reproductive Rights of Citizens.

    • Only heterosexual married couples are currently eligible.
    • Surrogacy must be medically indicated (i.e., the woman is unable to carry a pregnancy).
    • A formal surrogacy contract between the intended parents and the surrogate is required.
    • The surrogate has no parental rights over the child.

    Process

    1. Eligibility & Medical Assessment

    Intended parents must provide:

    • A marriage certificate
    • Medical documentation proving infertility or other health barriers
    • Consult a licensed fertility clinic or surrogacy agency in Bishkek

    2. Matching with a Surrogate

    The surrogate must meet legal and medical criteria:

    • Age 20–35
    • Has given birth before
    • Physically and psychologically healthy
    • Matching is done through clinics or local surrogacy coordinators

    3. Legal Contract

    A written surrogacy agreement is signed and notarized

    It defines:

    • Compensation
    • Rights and obligations
    • Medical process
    • Confidentiality
    • Both parties must undergo legal counseling

    4. IVF and Embryo Transfer

    IVF is performed using:

    • The couple’s own gametes, or
    • Donor eggs/sperm, if needed
    • Embryo is transferred to the surrogate after successful fertilization

    5. Pregnancy & Monitoring

    • Surrogate is monitored by the clinic during the pregnancy
    • Regular updates are provided to the intended parents
    • Pregnancy care meets basic medical standards, though not as advanced as in the U.S. or Western Europe

    6. Birth and Legal Parentage

    • The baby is delivered in a hospital in Kyrgyzstan
    • Intended parents are listed on the birth certificate directly
    • The surrogate has no claim to the child post-delivery

    7. Post-Birth Documents & Exit

    Apply for:

    • Birth certificate
    • Passport (if needed)
    • Exit visa or citizenship from the intended parents' home country
    • Agencies or legal advisors assist with embassy procedures
